The Financial Services Group closely coordinates with a number of our other practice groups on a broad range of customary credit transactions, as well as specialized finance issues, locally, regionally, nationally and internationally. Together we are one of the largest dedicated financial services teams in the Midwest, providing our financial industry clients with timely and skilled representation.

Our extensive experience in this industry has given us a deep understanding of the landscape of the industry and its marketplaces, cyclical trends and the business, credit, financial products and instruments, as well as the corporate, organizational and regulatory issues that financial institutions face across the life cycle of their activities and transactions.

Represented national bank in multi-stage financing for acquisition, development and construction of first Cabela’s-anchored shopping center in West Michigan

Represented national bank in acquisition financing for international vacuum manufacturer’s Illinois distribution facility

Represented national bank in construction financing for international vacuum manufacturer’s Virginia distribution facility

Represented administrative agent and lead bank in $100 million syndicated financing for the acquisition and renovation of an office tower in Detroit secured by a long-term ground lease

Represented a national bank in making a construction loan for the Zaragon Place West project (401 Thompson site) in Ann Arbor, MI, and in making a refinance loan for the Zaragon Place project (619 East University site) in Ann Arbor, Michigan

Represented national bank in multi-stage financing for acquisition, development and construction of first Costco-anchored shopping center in West Michigan

Represented administrative agent and lead bank in syndicated secured construction loan for development of a warehousing and light industrial project in the Pilsen neighborhood in Chicago

Represented a large national lender in its financing of a technology company with operations in the United States, Canada and the United Kingdom. Negotiated structure for both working capital lines of credit and real estate financing, including guarantees from affiliates from Canada and the United Kingdom 

Represented regional lender in financing of a private equity company purchase of a sports equipment manufacture which entailed negotiating the subordination of mezzanine debt, and perfecting security interests in intellectual property located in 16 countries

Represented the lead lender in a $107 million motor vehicle floor plan facility for an automobile dealership conglomerate, which included two additional bank participants and multiple parcels of real estate collateral located in a variety of states

Successfully prosecuted assignment of proceeds, forbearance and $155 million loan deals against sophisticated real estate developers in action involving deed-in-lieu of foreclosures and complex tax consequences. Judgment and collection in full obtained for national banking institution

Successfully defended national banking institutions in various claims involving allegations of fraud, UCC violations, breach of contract and conspiracy theories

Successfully defended Special Servicer in $300 million Certificate holders' action alleging breaches of Master Pooling and Servicing Agreement concerning notable New York hotel

Represented national banking institution lenders in large commercial foreclosure actions in Michigan and Ohio

Managed portfolio of foreclosure actions in Illinois

Represented regional bank in employment-related cases, which include discrimination claims and breach of contract claims filed by an executive that departed immediately prior to a merger with another bank

Represented a holding company in a securities class action lawsuit involving residential lending practices

Defended national bank in age discrimination and retaliation claims

Represented credit union organization in disability and age discrimination litigation

Advised credit union service provider on nationwide employee handbooks, policies, and human resources manuals

Provided respect in the workplace training for national bank

Provided COVID-19 workplace training for financial institutions

Successfully defended a publicly traded savings bank in federal class action litigation challenging the bank's overdraft and payment ordering processes and alleging millions of dollars in damages. Obtained dismissal and/or summary judgment of all tort, contract and statutory claims filed against the bank and upheld summary judgment ruling on appeal
