Participated in representation of an intercollegiate athletic association in defense of claims challenging limits on scholarship payments

AUTOMOTIVE

Served as co-lead counsel for tier-one supplier defendant in multi-district antitrust litigation alleging broad price-fixing conspiracy in the automotive industry. The case was successfully settled after pre-trial proceedings.

COMPUTER SOFTWARE

Successfully defended a point-of-sale software vendor in class action litigation filed by restaurant franchisees

CONSUMER CLASS ACTION

Worked as part of a team representing a commercial bank in a consumer class actions challenging bank’s overdraft fees

Successfully defended a law school in a consumer protection and fraud class action alleging the school misrepresented job placement and salary data to prospective students. The Western District of Michigan dismissed for failure to state a claim and the Sixth Circuit affirmed.

COVID-19

Successfully defended two universities against class actions seeking tuition refunds after change from in-person to on-line instruction during Covid-19 pandemic

EMPLOYMENT AND EQUAL PAY

Represented a public employer in a putative class action lawsuit alleging that female nurse practitioners were paid less than male physician assistants

Successfully defended multiple retiree health benefit class actions brought by former union employees alleging that modifications to their health benefits violated the terms of collective bargaining agreements

Represented a major retailer accused of race discrimination in a class action contesting its hiring and promotion decisions. The case was resolved for nuisance value.

ENVIRONMENTAL

Defended various industries in putative class actions brought under nuisance and negligence theories from purported industrial emissions

GOVERNMENTAL

Assisted in the defense of numerous municipalities against constitutional class action lawsuits challenging municipalities’ fees for regulatory services

Successfully defended a major city against a putative class action lawsuit that drew international attention regarding the city’s program of shutting off water to non-paying customers

OIL COMPANY

Successfully defended a major oil company in a putative class action involving allegations of underground storage tank leaks and related groundwater contamination

Represented a major oil company in a putative class action concerning nuisance and negligence allegations arising from an explosion at a refinery

Represented a Fortune 500 electronics manufacturer in the successful defense of a shareholder derivative claim
