Brian Orr is an experienced commercial litigator and intellectual property lawyer who represents clients in both transactional and litigation matters.
Brian has handled all aspects of patent, copyright, trademark and trade secret cases in federal and state courts throughout the country. These matters have involved various industries and technologies, including software, medical devices, aviation, manufacturing and apparel. In addition to his technical background in materials science, Brian has extensive experience with mechanical, chemical and software-related technologies.
Brian is registered to practice before the United States Patent and Trademark Office (USPTO) and has drafted and prosecuted patent applications covering a wide array of technologies. He also prosecutes trademark applications and drafts intellectual property-related license agreements.
Brian previously served as a law clerk to the Honorable Thomas E. Hoffman in the Illinois Appellate Court (First District) and as a judicial extern with Magistrate Judge Michael T. Mason, United States District Court, Northern District of Illinois.
Representative Matters
- Represented software developer in patent interference lawsuit in United States District Court for the Southern District of California, including working with electrical engineering expert to prepare report and defending expert at his deposition, as well as co-authoring and co-arguing Markman briefs and multiple motions for summary judgment.
- Represented automotive equipment manufacturer in patent infringement lawsuit in the United States District Court for the Eastern District of Michigan, including taking and defending multiple depositions in Italy and co-authoring patent infringement contentions and response to patent unenforceability and invalidity contentions.
- Second chaired two-week jury trial and obtained a $1.2 million verdict for breach of oral contract in the United States District Court of Colorado.
- Represented children's book publisher in international intellectual property acquisition.
- Reached settlements favorable to clients in intellectual property and commercial litigation cases involving various industries, including automotive, software, medical devices, sporting goods, financial services, aviation, construction, manufacturing and apparel.
- Prosecuted patent applications before the United States Patent and Trademark Office, including technologies related to computer software, agricultural equipment, electric bicycles, toys and other mechanical devices.
