Secured summary judgment for defendant hospital in a complex case under the Pregnancy Discrimination Act Amendments to Title VII, FMLA and common law. Plaintiff, an ICU nurse, alleged that her physical restrictions due to her pregnancy were not accommodated even though restrictions imposed on others for non-pregnancy related reasons had been. She further claimed that the lack of accommodation forced her to go onto FMLA leave earlier than she otherwise would have, and that as a result she ran out of post-partum FMLA time before she was physically ready to return to work.
