USCIS Announces Implementation of Phase 2 of Premium Processing Service for H-1B Cap-Subject Cases Beginning June 10, 2019
U.S. Citizenship and Immigration Services has announced that on June 10, the agency will begin Premium Processing Service for all remaining FY 2020 H-1B cap-subject petitions (containing either a Change of Status or Consular Processing request). Beginning on this date, Petitioning Employers may file an I-907, Request for Premium Process Service, in order to convert currently pending H-1B cap-subject petitions from regular processing to premium processing with the USCIS Service Center that is processing their petition. (Please note: If a Petition has been transferred to another Service Center since it was originally received for filing, the Premium Processing conversion request must be filed with the Service Center to which it was transferred instead of the one with which it was originally filed).
As a reminder, on March 19, USCIS had announced that it would offer premium processing in a two-phased approach during the FY 2020 cap season to best manage premium processing requests without fully suspending it. The first phase, which started on May 20, included FY 2020 cap-subject H-1B petitions requesting a change of status. The second phase (beginning today, June 10) includes all other FY 2020 cap-subject petitions, including those requesting Consular Processing.
At this time, please also note that Premium Processing Service for H-1B petitions that are otherwise exempt from the numerical cap, such as extension of stay requests, remains available.
Employers should notify Miller Canfield immediately if they wish to request Premium Processing Service for any remaining H-1B cap-subject cases.
