Miller Canfield’s Jeffrey Richardson and Joseph Gustavus Among Authors of Export Controls Guide

Miller, Canfield, Paddock and Stone PLC, a Detroit-based global law firm, has announced that Principal Joseph Gustavus and Senior Attorney Jeffrey Richardson have co-written a chapter in the “Dual-Use Export Controls of the European Union,” published by WorldECR.

The 230-page hard-copy book is a comprehensive resource on the regulations governing the export of dual-use items produced and sold in EU member states. Chapters contain detailed information on regulations in each country. Richardson and Gustavus worked with attorneys in Miller Canfield’s Polish offices to pen the chapter on Poland.

According to WorldECR, a publisher dedicated to information on global export controls, chapters are written by expert advisors in each member state. The guide was designed to benefit anyone with an interest in European export controls, and includes an introduction to the EU dual-use export control regime, as well as information and contact details for each of the national regimes.

“Global commerce in controlled military, aerospace, intelligence and other sensitive technologies is growing at a rapid pace, but their export faces intense governmental scrutiny from a national security perspective, and  is subject to export controls,” Gustavus said. “This ‘Dual-Use Export Controls’ guide can serve as a starting reference for companies to discover and frame EU export control compliance issues.”

The book answers question about domestic and international legislation, authorities responsible for enforcing and prosecuting violations in each jurisdiction, the process for gaining export authorizations, and penalties for failure to gain the proper authorization.

“This was a very difficult and expansive project by WorldECR,” Richardson said. “Each member state has its own export controls, much like how each state in the U.S. has its own systems for things like sales and use tax collection. Being able to put all that information about the member states in one guide was a massive undertaking.”

Richardson and Gustavus were recruited to write the chapter on Poland due to their expertise working with multinational clients. They are members of Miller Canfield’s Export Control Practice Group, and work extensively in export control compliance; international mergers, acquisitions and divestitures; and negotiating business terms and operational execution details between multinational companies.
