The U.S. Citizenship and Immigration Service (USCIS) released a revised Form I-129, Petition for Nonimmigrant Worker, which contains a new question about compliance with U.S. export controls under Export Administration Regulations (EAR) and International Traffic in Arms Regulations (ITAR). U.S. companies that fail to comply with these U.S. export controls when employing certain nonimmigrant workers may face monetary penalties and other significant sanctions from the U.S. government.
