Josh Carlisle is a corporate attorney who advises clients on a wide range of export controls, sanctions, customs and international trade issues, including the implementation of import and export strategies, customs compliance and trade regulations.
Export Controls & Economic Sanctions
Josh has assisted clients across a range of industries in navigating the requirements of the Export Administration Regulations (EAR), the International Traffic in Arms Regulations (ITAR) and U.S. sanctions laws and regulations administered by the Office of Foreign Assets Control (OFAC) and the U.S. Department of State. This includes controlled asset identification and classification, commodity jurisdiction requests, implementation of export control compliance programs, export license applications, drafting of government-approved TAAs, MLAs, other export control-compliant collaboration agreements, performing export control audits and rendering benchmark reports and performing export control due diligence on acquisition targets.
Customs and Import Compliance
As a licensed Customs Broker, Josh has extensive experience in managing global customs processes, mitigating trade risks and supporting regulatory compliance across various business sectors. His work includes evaluating and implementing U.S. antidumping and countervailing duties, enhancing contract transparency and developing internal control systems to ensure compliance in multinational settings. He has successfully assisted clients in navigating and ensuring compliance with U.S. Customs and Border Protection (CBP) rules and regulations. This includes proper assessment of the Harmonized Tariff Schedule of the United States (HTSUS), compliant country of origin determination, valuation and free trade agreement usage.
He is passionate about assisting clients with successfully navigating CBP detentions, seizures, forfeitures and mitigation of fines and penalties assessed by CBP. He routinely requests Binding Rulings from CBP to assist his clients with all necessary pre-compliance needs to ensure the use and documentation of “reasonable care”. He has experience in assisting with responding to CBP Requests for Information (CBP Form 28), responding to Notices of Action (CBP Form 29) and submitting Protests to CBP. He also specializes in mitigating the impact of enforcement actions by federal government agencies.
