Crista L. Rea's practice area is commercial litigation with a focus on mortgage remedies, construction liens and collection matters. She prosecutes power of sale and foreclosure actions on behalf of lenders in mortgage matters, and both prosecutes and defends construction lien matters. In the area of collections, she prosecutes or defends actions to judgment, concludes collection on judgment through garnishment, judgment debtor examinations, writ enforcements and asset seizures.
“Litigation is not what happens when people can't resolve disputes; rather, it's what happens when they fail to try. A focus on creative solutions and front-end resolutions saves clients the costs and uncertainty of protracted litigation.”
Crista L. Rea
Experience
Crista represented a physician whose previous counsel had failed to defend a series of actions against him related to the construction of his new home, including construction liens and writs of seizure among others. Furthermore, the former solicitor retained construction holdback trust funds in violation of Canada's Construction Lien Act and improperly paid himself from those funds. To add insult to injury, the client's builder had absconded to another country and was unavailable to respond to demands for payment by his creditors. Crista and her team helped their client successfully resolve all of the outstanding issues, and he is now the proud owner of a newly constructed home free from all encumbrances.
“As a physician, my client was knowledgeable, but as a new immigrant to Canada, he needed significant guidance. He placed a good deal of faith in me to act on his behalf, and I am pleased that I was able to achieve such a valuable solution that addressed all of his concerns with little interruption to his medical practice.”
